The Agreement will become effective when signed. Once the Agreement is signed, it may be terminated before the end of the Term if either party fails to comply with a material term or condition of the Agreement and does not remedy the failure within thirty (30) days of receiving written notice (the “Cure Period”).

This Agreement consists of this Signature Page, Exhibit “A” Terms and Conditions, and Exhibit “B” Swim Team Guidelines. As of the beginning of the Term, this Agreement will supersede all prior agreements between the parties relating to the subject matter of this Agreement. No supplement, modification, or amendment of this Agreement shall be binding unless executed in writing by authorized representatives of both parties.

Terms and Conditions



Fees

1. I understand that the entire monthly fee is due and payable by the 10th of each month. Dues will not be prorated if the Swimmer does not participate in the instructional sessions provided by DAQ. A $25.00 late fee will be assessed to payments made after the 10th of each month. NSF checks will be assessed an additional fee of $10.00 for a total late fee of $35.00. All outstanding fees must be paid in full by the end of the month or Swimmer will not be allowed to swim until the account is paid in full.



2. The monthly fee does not include costs for uniforms, accessories, meet fees, transportation, lodging, meals, and incidentals. These additional fees are due and payable upon request.



3. Swimmers who sign up for meets are obligated to pay the meet fee, whether they participate or not.



4. All Swimmers must be picked up within 15 minutes after practice ends. A $5.00 late charge will incur for every 10-minute interval the Swimmer remains.



5. I agree to participate in DAQ fundraising activities. I understand that such efforts and any donations help to maintain staff and equipment and support the cost of DAQ programs.



Legal Terms

1. I certify that the Swimmer is in good health and able to participate in DAQ activities. I hereby acknowledge that, as with all sports, there is a risk of personal injury involved in swimming. I further acknowledge that all activities, exercises, and courses of instruction provided by DAQ are taken at the Swimmer’s own risk. Participation in a DAQ activity may cause physical strain and possible muscle soreness. If the Swimmer’s physician has recommended that the Swimmer avoid strenuous activity or limit activity in any way, or if the Swimmer has any medical or coronary history that may be aggravated by the physical activities of DAQ activities, that it is my responsibility to determine with the Swimmer’s physician whether the Swimmer may participate in any given DAQ activity.



2. I hereby agree on behalf of myself and Swimmer to waive, release, and forever discharge DAQ and any and all affiliated organizations or companies, their directors, officers, shareholders, employees, agents, sponsors, vendors, instructors, coaches, supervisors and representatives, including volunteers (collectively “Releasees”), from any and all rights, responsibilities, liabilities, losses, damages, expenses, and costs which may be asserted by me or the Swimmer, or on behalf of the Swimmer, arising from or relating to participation in DAQ activities. I hereby agree to indemnify, defend and hold harmless Releasees from any and all liabilities, injuries, damages, lawsuits, costs (including attorneys’ fees) and claims, including negligence, which may be asserted arising from or relating to my participation or the Swimmer’s participation in DAQ activities.



3. I hereby grant DAQ permission to seek medical treatment for Swimmer in the event of an injury or emergency.



4. I acknowledge that DAQ is not responsible for who picks up the Swimmer from DAQ activities.



5. I assume all risks and hazards incidental to participation in a DAQ activity including transportation to and from the activities.



6. I authorize and give my full consent to DAQ to use the Swimmer’s name, voice, sound, likeness, and/or similar characteristics in any form or medium for the purpose of promoting and marketing its activities with third parties, any highlights, or for sale, without limitations, reservation or further prior written consent.



7. I agree that DAQ will not be held responsible for lost, stolen, or damaged items.



8. I understand that Swimmers may not engage in any drug or alcohol use or any physical fighting. Such activity will be grounds for immediate suspension of the Swimmer from DAQ activities, and expulsion from the DAQ program at the discretion of DAQ.









Exhibit “B”

Swim Team Guidelines



DAQ is a professional swim team and each participant is expected to represent the organization and themselves accordingly at all times. These Swim Team Guidelines while not intended to be comprehensive or to address all possible situations, do contain governing principles that all participants in the activities of DAQ must demonstrate and uphold. DAQ reserves the right to establish additional guidelines as necessary.



GENERAL BEHAVIOR GUIDELINES FOR SWIMMERS AND PARENTS



Competitive swimming programs provide many benefits to young athletes including self-discipline, good sportsmanship, and time management skills. Competition allows the swimmer to experience success and to learn how to treat success and failure as two sides of the same coin, while becoming healthy and physically fit. It is your responsibility, as a Parent/Guardian, to provide a stable, loving, and supportive environment that is conducive to encouraging your child to continue to participate. You can show your interest by ensuring your child’s attendance at practices, by coming to swim meets, or by participating in fundraising and other DAQ activities.



It is important for you to remember that your child is the swimmer. Avoid imposing your standards and goals; instead, allow them to establish their own goals and make progress towards them at their own pace. Avoid overburdening your child with winning or achieving best times and ask only that they give their best effort. An important part of the swimming experience is the chance for the swimmers to learn about themselves. The swimming environment encourages learning and fun, which will help your child to develop a positive self-image.



STANDARD BEHAVIORIAL GUIDELINES



DAQ Coaching Staff are professionals and Parents/Guardians and Swimmers must treat them as professionals and respect their decisions at all times. Failure to do so may result in suspension.



Parents/Guardians and Swimmers should set up an appointment to discuss general matters. Please do NOT contact the Coaching Staff before 10:00 a.m. or after 8:00 p.m., without an appointment, to discuss general matters.



Each Swimmer must participate in all team fundraising activities.



Each Swimmer must submit a photocopy of their school report cards to the appropriate coaching staff within 3 days of receipt.



Parents/Guardians and Swimmers must promote good sportsmanship by setting an example and by helping others to do likewise. DAQ swimmers win gracefully, lose graciously, and congratulate opponents under either circumstance.



Parents/Guardians and Swimmers must maintain open and honest communication among DAQ participants. We reach our common goal by working together.



Parents/Guardians and Swimmers must refrain from illegal or inappropriate behavior that detracts from a positive team image or performance objectives. If at any time the coaching staff believes that a swimmer is behaving in a manner that is disruptive to the team, the swimmer may be suspended. The suspension may be appealed through the Disciplinary Committee.






PRACTICE ATTENDANCE



Host Facilities, i.e., Agnes Scott and Bransby YMCA, must be respected at all times! Please adhere to the following rules:



Access to the building is granted to the swimming facilities and stands ONLY. All other areas are strictly off limits (e.g., lounge area, lobby, work-out equipment, phones) Running in the halls, destruction of any property, loud and boisterous behavior, is prohibited.



Assist the coaches in conducting effective practices by ensuring swimmers arrive and leave on time, and bring the proper equipment for their respectively scheduled practices – NO EXCEPTIONS. Enter through the locker room only – please DO NOT use the emergency doors to enter or exit.



All Swimmers must be picked up within 15 minutes after practice ends. A $5.00 late charge will incur for every 10-minute interval the Swimmer remains.



Only Swimmers and Coaches are allowed on the pool deck at any time. All others are expressly prohibited at all times. ALL swimmers and coaches must be off the pool deck by 8:30 p.m., on Monday – Thursday; 7:30 p.m. on Friday; and 2:00 p.m. on Saturday.



No food on pool deck at any time.



Park ONLY in the Tennis Lot or the Parking Deck and only in legal parking spaces. DO NOT block the street by idling or standing and waiting for swimmers to exit.



SWIM MEET PROTOCOLS



A Meet Sign-Up Sheet is posted one month prior to each meet. (Maps are distributed one week before the meet date.) Parents/Guardians must sign Swimmers up for swim meets. Meet fees are incurred at the time of sign-up. No changes will be made once the information has been submitted to the host team. There are 3 ways to sign up: 1) Leave a message for Melissa at 770-736-3512; 2) Online; 3) Send an email to daqswim@bellsouth.net.



Each Swimmer is responsible for knowing which events he/she is swimming and for arriving on time for check-in and being ready to swim.



Parents/Guardians must notify the coaching staff by phone immediately if a Swimmer is unable to attend a meet due to illness or emergency.



Parents/Guardians must accompany their Swimmer to all swim meets unless the Parents/Guardians provide prior written notification that other Parents/Guardians are in charge, or that the Swimmer is traveling independently.



Each Swimmer must complete all of his/her events before leaving the meet and must not leave the meet under any circumstances without the Coach’s permission.



Each Swimmer must wear Nike outfitting exclusively at all local, regional, national, and international competitions in accordance with the team sponsorship agreement with Nike, Inc. This includes team caps, suits, warm-ups, bags, etc. (Swim suit orders may be placed by calling 770-479-9655. Please specifically request the “DeKalb Aquatics” uniform).



Each Swimmer must remember that while wearing the DAQ uniform, his/her actions, words, and deeds reflect upon the entire team, so each Swimmer should conduct themselves in a manner that reflects self-respect, professionalism, and pride for DAQ.



Respect the integrity of swim officials by assuming decisions are based on honest, objective evaluations of performance. Only coaches may approach meet officials for clarification of rulings. Any questions or concerns regarding an officiating call, meet results, or the conduct of the meet should be brought to the attention of the coaching staff, which will decide to pursue the matter, as appropriate.



Swimmers must exhibit good sportsmanship at all times. When receiving awards in public, DAQ Swimmers must be prompt, cooperative, wear the appropriate team uniform, and exhibit dignity and respect during the presentation. Swimmers must be modestly thankful and receive congratulations with poise and courtesy. Swimmers must also be polite and congratulate other swimmers. If photos are taken, Swimmers must cooperate with the photographer and remain until the photo is taken.



Parent/ Guardian hereby acknowledge that they have read and understand the Swimming Guidelines and unconditionally agree to comply with the guidelines and governing principles set forth herein. Parent/ Guardian further acknowledges that failure to comply with the guidelines and governing principles as set forth herein may result in disciplinary action. Such discipline may include, but not be limited to: (1) Dismissal from the team and immediate return home (at the Parents/Guardians expense); (2) Disqualification from one or more events, or all events of competition; or (3) Disqualification from future DAQ travels.
